antique firearm: #"i've been told that a cap and ball pistol is considered a "primitive #weapon"" #- fl 790.001 definitions uses the term "antique firearm". #- fl 790.001 (6) says the term firearm shall not include an antique #firearm unless the antique firearm is used in the commission of a #crime #- fl 790.001 (3)(a) defines other catagories for "concealed weapon"(s) #i.e. "other deadily weapon" which, don't even try to kid yourself, #some pos cap and ball thingee is. # #hence, carry a loaded gun - it is a gun, cap and ball, flintlock or #glock, without a ccw permit - go to jail.
antique firearm: allegedly, people have been charged in texas with carrying a "deadly weapon" while carrying an antique friearm. but there don't seem to be any reports of this charge sticking. however, texas case law does say you have a positive duty to prove the firearm was pre-1899 ( if a cartridge gun ) and it cannot be used in a crime.
